Fences in Burlington

Burlington was first settled in 1641. In 1730 the area became Woburn's Second Parish, and in 1799 it became its own town. The parish meeting house, built in 1732, still stands at the top of Lexington Street, and the Francis Wyman House dates from 1666.

For most of its history Burlington was farm country. Then Route 128 was built. Between 1955 and 1965 Burlington was the fastest-growing town in Massachusetts. The Town Common and Simonds Park sit at the center of town.

There is a lot of open land, too. The Mill Pond Conservation Area sits on the Woburn and Wilmington side of town, and the Landlocked Forest reaches toward Bedford and Lexington. If your yard is near wetlands or conservation land, read the town rules below before you build.

The land rolls: the town's 2019 Open Space and Recreation Plan puts the low point at about 100 feet above sea level, on the southeast edge of town between Cambridge and Winn Streets, and the high point at about 300 feet, at Greenleaf Mountain. The plan says the areas with the most flooding potential include land next to Sawmill Brook, from the Wilmington town line to Lucaya Circle, and most of the land along Longmeadow Brook, Sandy Brook, and Vine Brook. It also says many homes near streams in the town's flood zones have basements and lawns that flood from time to time in heavy rain.

Carmen will walk your yard with you, ask what the fence has to do (privacy from the neighbors, a safe yard for kids and dogs, a pool area), and talk through what makes sense for your lot. Replacing a worn-out fence? Low-maintenance vinyl never needs paint or stain.

Before you build

Burlington fence permits and rules

Here is what the Town of Burlington's website and bylaws say, in plain words. Rules can change and every lot is different, so check with the Burlington Building Department before you build.

  • Ask about a permit first. The Building Department says most projects need a building permit before work begins, and it takes applications online. If you are not sure your fence needs one, the town asks you to call the Building Department.
  • Near wetlands or conservation land. The town says to contact the Conservation Department before you apply if your project is near wetlands or conservation areas. Conservation Department: 25 Center Street, (781) 270-1655.
  • Floodplain. Burlington's zoning bylaw (Section 8.1.4) requires a permit for all construction or other development in the floodplain overlay district, and it names fences.
  • Not in the street. The town's general bylaws (Article XIII, Section 1.5) say no one may put up or keep a fence that extends into or on a street.
  • Pools. The Building Department's fee schedule lists permits for above-ground and in-ground swimming pools.
  • Height and corner lots. Ask the Building Department what applies to your lot before you pick a fence height.
  • Where to ask. Burlington Building Department, 25 Center Street, Burlington, MA 01803, (781) 270-1615. Open Monday, Tuesday and Thursday 8 am to 4:30 pm, Wednesday 8 am to 7 pm, and Friday 8 am to 1 pm.

My yard is near wetlands or conservation land. Does that change anything?

It can. The town asks you to contact the Conservation Department at (781) 270-1655 before you apply if your project is near wetlands or conservation areas.
